Debt Recovery –
If you are seeking the recovery of an unpaid debt, there are several avenues available to recover the outstanding debt. Which avenue you decide to pursue will depend on the nature of the debt and the amount claimed. In Queensland the options available are:
- An application to the Queensland Civil and Administrative Tribunal (“QCAT”); or
- The commencement of an action by way of either a Claim and Statement of Claim or Application in the Supreme, District or Magistrates Court.
QCAT is usually the most cost effective options of individual and businesses to pursue a minor debt for claims that do not exceed the maximum monetary limit of $25,000.
For claims greater than $25,000 you may want to consider engaging us to assist in the debt recovery process. The monetary jurisdictional limits for the Courts are:
- Magistrates Court – up to $150,000
- District Court – $150,000 to $750,000
- Supreme Court – greater than $750,000
Once a judgment has been obtained, there are also several options to recover the debt.
